Terms of Service

These Terms govern Vibe Apply, a service operated by AIVERSE LLC, a Delaware limited liability company. They apply to your access to and use of Vibe Apply's website, applications, AI-powered job-search tools, and related services (collectively, the "Services").

By accessing, creating an account with, or using Vibe Apply, you agree to these Terms. If you do not agree, you may not use the Services.

You must be at least 18 years old or have reached the age of legal majority in your jurisdiction to use Vibe Apply. By using the Services, you represent that you are legally capable of entering into these Terms.

You agree to provide accurate and current information when creating and maintaining your account. You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

Vibe Apply may allow you to connect third-party accounts or save credentials associated with applicant tracking systems ("ATS") and job application platforms. We use reasonable safeguards designed to protect information maintained through the Services. You are responsible for ensuring that you are authorized to use any accounts or credentials you provide or connect.

You may not impersonate another person, create accounts using false identities, gain unauthorized access to another user's account, share or misuse accounts, or use Vibe Apply for unlawful or fraudulent purposes.

Vibe Apply provides tools designed to assist users throughout the job-search process. Features may include job discovery and matching, resume creation and analysis, application assistance and automation, application tracking, Autofill Profile functionality, networking tools, company information, and other AI-powered career tools.

Features may change, be added, removed, limited, suspended, or discontinued from time to time. We do not guarantee that every feature will always be available or compatible with every employer, job board, website, applicant tracking system, or other third-party service.

Vibe Apply may assist you in completing or submitting job applications based on information in your profile, resume, application preferences, saved answers, and other information you provide.

You authorize Vibe Apply to use information you provide to perform application-related actions that you request or enable. Depending on the features you select, this may include completing application fields, creating or using applicant accounts, providing application responses, uploading documents, and transmitting or submitting information to employers, recruiters, job boards, or applicant tracking systems.

Vibe Apply may perform application-related actions based on the information, preferences, and instructions you provide. Automated systems may occasionally produce incorrect, incomplete, duplicate, delayed, or unintended results. You are responsible for maintaining accurate account and application information and for reviewing your application activity where appropriate.

Vibe Apply does not guarantee that an application or other automated action will be completed successfully or that a third-party system will receive, accept, process, retain, or respond to an application. We are not responsible for changes, errors, restrictions, downtime, or other actions of employers, job boards, applicant tracking systems, or other third-party services.

Vibe Apply may allow you to connect Gmail or other third-party services to retrieve authorized verification codes, track applications, and identify job-related updates.

Connecting Gmail is optional. When you connect your Google Account, you authorize Vibe Apply to access information within the permissions you approve. Vibe Apply does not require your Gmail password to establish this connection.

Relevant Gmail message metadata and body content may be processed by service providers acting on Vibe Apply's behalf solely to provide the Gmail-connected features you enable. You may disconnect connected services at any time. Your use of Google and other third-party services remains subject to their respective terms and policies.

Vibe Apply uses artificial intelligence and automated technologies to provide certain features, including resume assistance, job matching, application assistance, networking assistance, and application tracking.

AI-generated recommendations, content, scores, application responses, job matches, classifications, and other outputs may contain errors, omissions, or inaccuracies. You should review important information before relying on it or submitting it where appropriate.

Vibe Apply does not guarantee the accuracy, completeness, reliability, suitability, or outcome of AI-generated content, recommendations, or automated actions.

Vibe Apply is a technology platform designed to assist with the job-search process. Vibe Apply is not an employer, staffing agency, recruitment agency, immigration advisor, or representative or agent of employers displayed through the Services unless expressly stated otherwise.

We do not control employers' hiring decisions and do not guarantee interviews, responses, employment offers, compensation, employment, sponsorship, immigration eligibility, or any other employment-related outcome.

Job listings, company information, salary information, sponsorship information, match scores, recommendations, and other employment-related information may originate from third parties or automated systems and may be incomplete, outdated, or inaccurate. Users should independently verify information that is important to their employment, immigration, financial, or career decisions.

You retain ownership of resumes, profile information, documents, application materials, and other content you provide to Vibe Apply.

You grant Vibe Apply a limited, worldwide, non-exclusive license to host, process, reproduce, modify, and transmit your content as reasonably necessary to operate, maintain, improve, and provide the Services you request. This license does not expand our rights to use saved credentials or Google user data, which are handled as described in our Privacy Policy.

You represent that you have the necessary rights to information and materials you provide and that your content does not violate applicable law or the rights of others.

You are responsible for the accuracy and legality of information you submit through the Services. Vibe Apply may remove, restrict, or refuse content that we reasonably believe violates these Terms, applicable law, or the rights of others.

Vibe Apply may provide information and tools intended to help users identify and communicate with professional contacts, recruiters, employees, hiring managers, or other individuals.

Networking information may originate from third-party sources and may not always be complete, accurate, or current. You are responsible for using networking features lawfully and professionally.

You may not use Vibe Apply to send spam, harassment, deceptive communications, unauthorized mass communications, or communications that violate applicable laws or third-party policies.

Vibe Apply may offer free and paid plans. Prices, features, usage limits, credits, discounts, and other plan benefits will be displayed through the Services or at the time of purchase and may change from time to time.

Paid subscriptions may renew automatically at the applicable billing interval unless canceled before the next renewal date. By purchasing a subscription, you authorize our payment provider to charge the applicable payment method for subscription fees and applicable taxes.

You may cancel your subscription through the available account or subscription controls. Cancellation generally prevents future renewal charges and does not automatically provide a refund for charges already processed. Unless otherwise required by applicable law or expressly stated at the time of purchase, payments are non-refundable.

Vibe Apply may use credits, usage limits, promotional credits, discounts, referral benefits, or similar mechanisms. Credits have no cash value, are non-transferable unless expressly permitted, and may expire, reset, or be subject to limitations according to the applicable plan or promotion.

We may modify pricing, plan features, credit rules, usage limits, and promotional programs as the Services evolve. Changes affecting existing paid subscriptions will apply in accordance with applicable law.

You agree not to misuse Vibe Apply or interfere with its normal operation. You may not attempt unauthorized access to the Services or another person's accounts; circumvent security, subscription, credit, or usage restrictions; introduce malware or harmful code; engage in fraud or unlawful activity; abuse automated functionality; systematically scrape, harvest, mine, or extract proprietary content or data without authorization; reverse engineer protected portions of the Services except where permitted by law; resell unauthorized access to the Services; or use the Services in a manner that harms Vibe Apply, its users, or third parties.

You may not intentionally provide fraudulent resumes, qualifications, identities, application information, or other materially false information through the Services.

We may restrict, suspend, or terminate access when we reasonably believe the Services are being misused.

Vibe Apply and its software, interfaces, designs, branding, graphics, algorithms, databases, platform functionality, original content, and other proprietary materials are owned by Vibe Apply or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose.

Except as expressly permitted, you may not copy, reproduce, distribute, sell, license, modify, reverse engineer, commercially exploit, or create competing products from Vibe Apply's proprietary materials or Services.

The Vibe Apply name, logo, branding, and related marks may not be used without prior authorization.

Vibe Apply may interact with employers, recruiters, job boards, applicant tracking systems, authentication providers, payment providers, data providers, and other third-party services.

Vibe Apply does not own or control these third-party services and is not responsible for their availability, accuracy, security, policies, decisions, actions, content, or changes.

Third-party services may modify their websites, APIs, application processes, security requirements, access rules, or other systems at any time. Such changes may affect the availability or operation of certain Vibe Apply features.

Your interaction with third-party services may also be subject to their own terms, privacy policies, and other requirements.

The Services may occasionally contain errors, inaccuracies, or omissions, including information relating to jobs, employers, salaries, sponsorship, pricing, subscriptions, features, availability, or other information.

We reserve the right to correct errors, inaccuracies, or omissions and to update or modify information through the Services at any time, subject to applicable law.

We do not guarantee that Vibe Apply or any particular feature will be available at all times. The Services may experience interruptions, delays, maintenance, technical problems, errors, or temporary unavailability.

Certain functionality depends on third-party platforms and services outside our control. We are not responsible for interruptions or limitations resulting from changes, failures, restrictions, outages, or other circumstances involving those third parties.

We may modify, suspend, limit, or discontinue all or part of the Services as reasonably necessary for business, operational, security, legal, or technical reasons.

We use reasonable measures to maintain the Services and information associated with your account. However, no system can guarantee against every instance of data loss, corruption, deletion, or technical failure.

You are responsible for maintaining copies of important resumes, documents, application materials, and other information where appropriate. To the fullest extent permitted by applicable law, Vibe Apply is not responsible for losses resulting from the loss or corruption of user data beyond obligations that cannot legally be excluded.

Our handling of personal information is further described in our Privacy Policy.

Your use of Vibe Apply is governed by our Privacy Policy, which explains how information is collected, used, disclosed, retained, and protected.

By using connected services or application-related functionality, you acknowledge that information may be processed or transmitted as necessary to provide the features you request or enable.

By using Vibe Apply, you consent to receive electronic communications relating to your account, transactions, subscriptions, security, applications, support requests, changes to the Services, and other service-related matters.

You agree that electronic notices, disclosures, agreements, and other communications may satisfy legal requirements that such communications be in writing to the extent permitted by applicable law.

Marketing communications, where applicable, will be handled in accordance with applicable law and available communication preferences.

You may stop using Vibe Apply at any time and may close your account through available account controls.

We may suspend, restrict, limit, or terminate access to some or all of the Services if we reasonably believe you have violated these Terms, misused the Services, engaged in fraudulent or abusive activity, created legal or security risk, interfered with the Services, or where action is otherwise reasonably necessary to protect Vibe Apply, our users, or third parties.

Where appropriate, we may also prevent users whose accounts were terminated for serious violations from creating replacement accounts.

Provisions that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related matters, will survive termination.

To the fullest extent permitted by applicable law, Vibe Apply and the Services are provided on an "as is" and "as available" basis.

We do not warrant that the Services will always be uninterrupted, secure, error-free, accurate, complete, or compatible with every third-party website, system, or service.

Vibe Apply makes no guarantee regarding job availability, application submission or delivery, application status, employer responses, interviews, employment offers, hiring outcomes, compensation, immigration or visa sponsorship, or other employment-related outcomes.

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, Vibe Apply and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, opportunities, goodwill, employment opportunities, or other intangible losses arising from or related to your use of or inability to use the Services.

Vibe Apply is not responsible for hiring decisions or actions taken by employers, recruiters, job boards, applicant tracking systems, or other third parties, or for losses resulting from inaccurate information supplied by users, automated systems, or third parties.

To the fullest extent permitted by applicable law, Vibe Apply's aggregate liability for claims arising from or relating to the Services will not exceed the greater of the amount you paid to Vibe Apply during the twelve months preceding the event giving rise to the claim or $100.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of these provisions may not apply to you.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Vibe Apply and its affiliates, owners, officers, employees, contractors, and representatives from claims, damages, liabilities, losses, and reasonable expenses arising from your misuse of the Services, violation of these Terms, violation of applicable law, information or content you submit, or infringement of another person's rights.

We reserve the right to assume the defense and control of matters subject to indemnification where appropriate.

We may modify, update, suspend, limit, or discontinue features of the Services from time to time.

We may also update these Terms as Vibe Apply evolves or as necessary to address legal, regulatory, security, technical, or operational requirements. When we update these Terms, we will post the revised version and update the Effective Date.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

These Terms and your use of the Services are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

These Terms, together with our Privacy Policy and any additional terms expressly presented to you for particular Services, constitute the agreement between you and Vibe Apply concerning your use of the Services.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as necessary, and the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or other business transaction, or as otherwise permitted by law.

Vibe Apply will not be responsible for delays or failures resulting from circumstances reasonably beyond our control.

Nothing in these Terms creates an employment, partnership, joint venture, fiduciary, franchise, or agency relationship between you and Vibe Apply. Vibe Apply does not act as your agent or as an agent of an employer merely because you use the Services.
